Therefore, the data provided to PRODUMIX must be personal data corresponding to the user\u2019s own identity and must be adequate, relevant, current, accurate and truthful. In this regard, the user shall be solely responsible for any direct or indirect damage caused to third parties or to PRODUMIX through the use of another person\u2019s data, or through the use of their own data when such data is false, incorrect, outdated, inadequate or irrelevant. Likewise, any user who communicates the personal data of a third party shall be responsible for having obtained the corresponding authorisation from the data subject, as well as for any consequences arising otherwise.<\/p>\n\n<p>Similarly, any user who communicates personal data to PRODUMIX declares that they are of legal age in accordance with Spanish law and shall refrain from providing data to PRODUMIX otherwise. Any data provided concerning a minor shall require the prior consent or authorisation of their parents, guardians or legal representatives, who shall be considered responsible for the data provided by the minors under their care.<\/p>\n\n<h3>Purposes of collecting and processing personal data<\/h3>\n\n<p>PRODUMIX, as data controller, informs users of the existence of various processing activities and files in which personal data communicated to PRODUMIX is collected and stored.<\/p>\n\n<p>The purposes of such collection and processing of personal data are as follows:<\/p>\n\n<p>Regarding the cookies used by PRODUMIX when browsing its websites, these are stored on the user\u2019s terminal equipment, computer or mobile device, and collect information when visiting such websites, with the purpose of improving their usability, understanding users\u2019 browsing habits or needs in order to adapt to them, as well as obtaining information for statistical purposes. Not wishing to receive these cookies does not prevent access to the information on PRODUMIX websites, although the use of some services may be limited. If, after giving consent to receive cookies, the user wishes to withdraw such consent, the cookies stored on the user\u2019s device must be deleted through the options available in the different browsers.<\/p>\n\n<p>All information about the cookies used by PRODUMIX is published in its Cookie Policy, available for consultation at <a href=\"http:\/\/www.produmix.com \/cookies.\">http:\/\/www.produmix.com \/cookies.<\/a><\/p>\n\n<p>In the case of sending an email to PRODUMIX or communicating personal data by any other means, such as a contact form, the purpose of collecting and processing such data by PRODUMIX is to respond to queries and requests for information concerning PRODUMIX products and services.<\/p>\n\n<h3>Personal data retention period<\/h3>\n\n<p>PRODUMIX shall retain personal data for the time strictly necessary to fulfil the purposes described above. PRODUMIX may keep such data duly blocked for the period during which liabilities may arise from its relationship with the customer.<\/p>\n\n<p>In the case of data retained pursuant to Law 25\/2007, of 18 October, on the retention of data relating to electronic communications and public communications networks, the retention period shall be that set out in said regulation.<\/p>\n\n<h3>Recipients of personal data<\/h3>\n\n<p>The recipients of the personal data collected by PRODUMIX shall be the following:<\/p>\n\n<ol>\n<li>PRODUMIX\u2019s own employees in the performance of their duties.<\/li>\n<li>PRODUMIX suppliers involved in the provision of services, where necessary for the provision of such services.<\/li>\n<li>Judicial or administrative bodies, as well as State Security Forces and Corps, where PRODUMIX is required under applicable legislation to provide information relating to its customers and services.<\/li>\n<\/ol>\n\n<h3>User rights and how to exercise them<\/h3>\n\n<p>Users may exercise the following rights recognised by the GDPR at any time:<\/p>\n\n<ol>\n<li>Right of access. Users have the right to obtain information from PRODUMIX as to whether personal data concerning them is being processed, to access such data and to obtain information about the processing carried out.<\/li>\n<li>Right to obtain a copy of their personal data.<\/li>\n<li>Right to rectification.<br>Users have the right to have PRODUMIX rectify their personal data where it is inaccurate or incomplete.<\/li>\n<li>Right to erasure.<br>Users have the right to request the deletion of data when it is no longer necessary for the purpose for which it was provided or when any of the other legally established circumstances apply.<\/li>\n<li>Right to restriction of processing.<br>Users have the right to request the restriction of the processing of their personal data, so that the processing operations that would otherwise apply are not carried out, in the cases provided for in Article 18 of the GDPR.<\/li>\n<li>Right to data portability.<br>Users have the right to receive the personal data concerning them in a structured format, provided that such data concerns only the user and has been provided by the user.<\/li>\n<\/ol>\n\n<p>Users may exercise these rights as follows:<\/p>\n\n<p>Users may exercise their rights by sending an email communication to <span id=\"cloak0dfbd80af2e211b1bbca748f7f6c712a\"><a href=\"mailto:info@produmix.com\">info@produmix.com<\/a><\/span><script type=\"text\/javascript\">\n\t\t\t\tdocument.getElementById('cloak0dfbd80af2e211b1bbca748f7f6c712a').innerHTML = '';\n\t\t\t\tvar prefix = '&#109;a' + 'i&#108;' + '&#116;o';\n\t\t\t\tvar path = 'hr' + 'ef' + '=';\n\t\t\t\tvar addy0dfbd80af2e211b1bbca748f7f6c712a = '&#105;nf&#111;' + '&#64;';\n\t\t\t\taddy0dfbd80af2e211b1bbca748f7f6c712a = addy0dfbd80af2e211b1bbca748f7f6c712a + 'pr&#111;d&#117;m&#105;x' + '&#46;' + 'c&#111;m';\n\t\t\t\tvar addy_text0dfbd80af2e211b1bbca748f7f6c712a = '&#105;nf&#111;' + '&#64;' + 'pr&#111;d&#117;m&#105;x' + '&#46;' + 'c&#111;m';document.getElementById('cloak0dfbd80af2e211b1bbca748f7f6c712a').innerHTML += '<a ' + path + '\\'' + prefix + ':' + addy0dfbd80af2e211b1bbca748f7f6c712a + '\\'>'+addy_text0dfbd80af2e211b1bbca748f7f6c712a+'<\\\/a>';\n\t\t<\/script> or by sending a request accompanied by their National Identity Document or another legally valid document proving their identity, addressed to PRODUMIX S.A., C\/ Camino de Alberite, 41, 26006 Logro\u00f1o, La Rioja, Spain, for the attention of the Human Resources Department, specifying the right they wish to exercise.<\/p>\n\n<p>In the case of requests that are manifestly unfounded or excessive due to their repetitive nature, PRODUMIX reserves the right to charge a fee for the administrative costs incurred or to refuse to act on such requests, in accordance with Article 12.5 of the GDPR.<\/p>\n\n<h3>Supervisory authority<\/h3>\n\n<p>Users and\/or customers may contact the corresponding local supervisory authority if they consider that the processing of their personal data has not been carried out in accordance with applicable legislation.<\/p>\n\n<p>The data protection supervisory authority in Spain is the Spanish Data Protection Agency, whose contact details are available on its website, specifically at <a href=\"http:\/\/www.agpd.es\/portalwebAGPD\/CanalDelCiudadano\/contacteciudadano\/index-ides-idphp.php.\">http:\/\/www.agpd.es\/portalwebAGPD\/CanalDelCiudadano\/contacteciudadano\/index-ides-idphp.php.<\/a><\/p>\n\n<h3>PRODUMIX as data processor<\/h3>\n\n<p>In accordance with Article 28 of the GDPR and related provisions, PRODUMIX shall process personal data in respect of which the customer acts as data controller or data processor, where this is necessary for the proper provision of the contracted services. In such cases, PRODUMIX shall act as data processor, under the terms set out below:<\/p>\n\n<p>PRODUMIX shall process the data solely in accordance with the instructions of the customer acting as controller or processor, and shall not use it for any purpose other than that set out in this Data Protection Policy and\/or in the applicable contractual terms.<\/p>\n\n<p>Once the provision of the services giving rise to the processing of personal data has been completed, such data shall be destroyed, as shall any media or documents containing personal data or any type of information generated during, for and\/or as a result of the provision of the services covered by the corresponding Terms. Notwithstanding the foregoing, PRODUMIX may keep such data duly blocked for the period during which liabilities may arise from its relationship with the customer.<\/p>\n\n<p>If PRODUMIX uses the data for another purpose or communicates or uses it in breach of this Data Protection Policy and\/or the corresponding Service Terms, it shall also be considered the data controller.<\/p>\n\n<p>PRODUMIX undertakes, in accordance with Article 28 of the GDPR, to maintain due professional secrecy regarding the personal data to which it must have access and\/or which it must process in order to comply, in each case, with the purpose of the Service Terms applicable to it, both during and after the termination thereof. It undertakes to use such information solely for the purpose established in each case and to require the same level of commitment from any person within its organisation who participates in any stage of the processing of personal data under the responsibility of the customer.<\/p>\n\n<p>In accordance with the GDPR, the following rules shall apply regarding the form and methods of access to data for the provision of services:<\/p>\n\n<p>Access to and\/or processing of data by PRODUMIX, without prejudice to any specific legal or regulatory provisions in force that may apply in each case or those adopted by PRODUMIX on its own initiative, shall be subject to the security measures necessary to:<\/p>\n\n<ul>\n<li>Guarantee the ongoing confidentiality, integrity, availability and resilience of processing systems and services.<\/li>\n<li>Restore the availability of and access to personal data quickly in the event of a physical or technical incident.<\/li>\n<li>Regularly verify, evaluate and assess the effectiveness of the technical and organisational measures implemented to ensure processing security.<\/li>\n<li>Pseudonymise and encrypt personal data, where applicable.<\/li>\n<\/ul>\n\n<p>The customer authorises PRODUMIX, in its capacity as data processor, to subcontract with third parties, in the name and on behalf of the customer, storage services, backup custody and security services, and any other services necessary to enable the provision of the contracted services, while in all cases complying with the obligations imposed by the GDPR and its implementing regulations. At any time, the customer may contact PRODUMIX to learn the identity of the entities subcontracted for the provision of the aforementioned services, which shall act in accordance with the terms set out in this document and subject to the prior formalisation with PRODUMIX of a data processing agreement in accordance with Article 28.4 of the GDPR.<\/p>\n\n<p>The customer authorises PRODUMIX to carry out the actions indicated below, provided that they are necessary for the execution of the services. Such authorisation is limited to the action or actions necessary for the provision of each service and for a maximum duration linked to the term of the applicable contractual terms:<\/p>\n\n<p>To carry out the processing of personal data on portable devices only by users or user profiles assigned to the provision of the services.<\/p>\n\n<p>To carry out processing outside the premises of the customer or PRODUMIX only by users or user profiles assigned to the provision of the services.<\/p>\n\n<p>PRODUMIX shall not be liable for any breach of the obligations arising from the GDPR or the corresponding data protection regulations by the user and\/or customer in relation to their own activity and in connection with the execution of the contract or commercial relationship linking them to PRODUMIX.
